Terms and Conditions

Please read these Terms and Conditions (“Terms,” “Terms and Conditions”) carefully before using the www.scribefreelance.com website (the “Service”) operated by Scribe Freelance (“I,” “me,” or “my”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.
1. Services
I provide book design services, including but not limited to cover design, interior layout, eBook formatting, and editing. The specifics of each service, including deliverables, timeline, and pricing, will be agreed upon in writing (including email) before the commencement of any work.
2. Payments
All payments are due as per the agreed-upon schedule. I reserve the right to pause or terminate work on projects with outstanding payments.
3. Refunds
Due to the custom nature of my services, refunds are not typically offered. In exceptional circumstances, refunds may be considered at my discretion.
4. Intellectual Property
Client Content: You retain all rights to the content you provide (text, images, etc.). You grant me a license to use this content solely for the purpose of providing my services. You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights for any fonts, stock images, photographs, or other third-party materials you provide to me for use in your project. You agree to indemnify and hold Scribe Freelance harmless from any claims, damages, or legal costs arising from unlicensed or improperly licensed materials you supply.
My Designs: Until final payment is received, I retain ownership of all designs created. Upon full payment, you will receive the agreed-upon final deliverables (e.g., print-ready PDF and/or ePub files, as specified in our service agreement). Editable source files (e.g., native InDesign, Photoshop, or Illustrator files) are not included unless explicitly stated in the project proposal and paid for separately. Project files are retained for 5 years after project completion; retrieval of archived files after this point, or reopening a completed project, may incur an archival fee.
5. Revisions and Alterations
I offer a set number of revisions as specified in our individual project proposal. Additional revisions may incur extra charges.
6. Client Responsibilities
You agree to provide all necessary materials (text, images, etc.) in a timely manner and to review and provide feedback on designs promptly. You are solely responsible for the accuracy of all content, including spelling, grammar, and factual details, prior to final approval.
7. Final Approval and Proofing
Once you provide written approval of the final files and remit full payment, the project is considered complete and closed. From that point forward, you assume full responsibility for reviewing and proofreading the approved files. Scribe Freelance is not liable for typographical errors, layout issues, or other mistakes that were present in the approved files and are discovered after printing, publishing, or distribution, nor for any resulting printing, manufacturing, reprinting, or distribution costs. This does not limit liability for errors I introduce after your final approval, such as in a subsequent revision you did not request or sign off on.
8. Abandoned Projects
If you fail to provide feedback, approvals, or required materials for more than 45 consecutive days, the project may be considered abandoned. In such cases, any deposit paid is non-refundable, and a restart fee may apply to resume or reopen the project.
9. Termination
I reserve the right to terminate services if there’s a breach of these Terms or our service agreement.
10. Limitation of Liability
Scribe Freelance shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of my services.
11. Indemnification
You agree to indemnify and hold Scribe Freelance harmless from any claims resulting from your use of my service, your provided materials, or any violation of these Terms.
12. Changes to Terms
I reserve the right to modify or replace these Terms at any time. I’ll provide notice of any significant changes.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of New York State/United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Oswego County, New York.
